Terms of Service

This website and the services described on it are owned and operated by Marian Noah Joseph Rajan (Hope Takumi, Sole Proprietorship). In these terms, “we” and “us” mean Hope Takumi, and “you” means the person or business using our website or services. By sending us an enquiry, accepting a quotation or paying us, you agree to these terms.

1. Our services

We design, build and maintain software: AI solutions, websites, mobile apps, custom software and SaaS, design and branding, and cloud hosting and maintenance. The exact work, deliverables and timeline for each project are set out in a written quotation.

2. Quotations and prices

• All prices are in INR (₹) unless the quotation says otherwise.
• Prices shown on our website are starting prices. The final cost depends on the scope of your project.
• Before any payment, we send you a written quotation with the scope, price, payment schedule and timeline. Work starts only once you have agreed to it in writing (email or WhatsApp is enough).
• Applicable taxes, if any, are shown in the quotation.
• A quotation is valid for 30 days unless it says otherwise.

3. Payment

• Unless the quotation says otherwise, 50% of the project price is paid in advance before work starts, and the balance is paid on delivery.
• Payments are made through a Razorpay payment link that we send after the quotation is agreed. We do not take card or UPI details ourselves.
• Monthly services, such as hosting and maintenance, are paid in advance for each month.
• If a payment is late, we may pause work until it is made. Agreed dates move by the length of the pause.

4. Changes in scope

If you want something that is not in the quotation, we tell you the extra cost and time first. Nothing extra is billed unless you agree to it in writing.

5. What we need from you

Timely feedback, content, accounts and access that the project needs. Delays in these can move the timeline. You confirm that you have the right to use any material you give us (text, images, logos, data).

6. Delivery

All work is delivered digitally, as set out in our Shipping & Delivery Policy.

7. Cancellation and refunds

You can cancel at any time in writing. Refunds follow our Refund & Cancellation Policy.

8. Ownership and intellectual property

• Once the project is paid in full, the rights to the work we created specifically for you (code, designs and files) pass to you, and we hand over access and documentation.
• Until then, we keep those rights, and you may use delivered work only to review it.
• Open-source libraries, fonts, third-party services and our own general tools stay under their own licences; we tell you about any that need a paid licence.
• We do not show your project in our portfolio without your written permission.

9. Confidentiality

We keep your business information, data and accounts confidential and use them only for your project. We are happy to sign a non-disclosure agreement.

10. Fixes and support

We fix defects in delivered work for the period stated in the quotation. Ongoing support, updates and hosting are separate services unless the quotation includes them.

11. Third-party services

Projects often use services such as hosting providers, app stores, payment gateways or AI model providers. Their own terms and fees apply, and we are not responsible for their outages or changes.

12. Limitation of liability

We build carefully and test our work, but no software is free of errors. To the extent the law allows, our total liability for any claim relating to a project is limited to the amount you paid us for that project, and we are not liable for indirect or consequential losses such as lost profits, revenue or data. Nothing in these terms limits liability that cannot be limited by law.

13. Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Nagercoil, Kanniyakumari District, Tamil Nadu. We will always try to resolve a concern by talking first.

14. Changes to these terms

We may update these terms. The version that applies to your project is the one in force when you accepted its quotation.
